The plaintiffs claim the defendants made multiple false representations between March 2020 and June 2020 about the KN95 masks being "FDA and CE certified" and that they "had passed filtration tests required" to meet additional standards, the opinion said.

A Maryland district court judge recently dismissed two civil RICO charges against entities accused of manufacturing, marketing and selling fraudulent certified personal protective equipment during the pandemic, finding the complaint failed to allege a pattern of racketeering activity.

The plaintiffs, AMA Systems LLC and Bluemar Promotions LLC, filed a lawsuit in the U.S. District Court for the District of Maryland, alleging claims of civil violation of the Racketeer Influenced and Corrupt Organizations Act, conspiracy to violate RICO, common law fraudulent misrepresentation, and breach of contract. The defendants include three entities, 3B Tech Inc., an Indiana-based importer, distributor and seller of various products; Pro-Com, a California-based importer and distributor of packaged goods; Salusen, an Indiana-based online retailer of PPE, as well as owners and/or officers of the entities.
